Subscribing and downloading Content of this site (images, sound clips or any other file) does not transfer intellectual property rights, title or ownership to you. You may use the files as permitted in License Agreement for your commercial or non-commercial projects, you may sell such project without paying any royal ties to us, but you may not redistribute or sell the Content itself. (That means you can use the files to create your projects and of course sell your project, but you may not grab these files and sell or redistribute them, because they are not yours, they are licensed to you)

License Agreement

DVDStyle.com grants you a non-exclusive and non-transferable license to use the Images and Files only as provided in this License Agreement.

Subscription, Schedule, Cancelation

Subscription is on monthly basis period. All accounts are renewed automatically until a cancellation request is received. Cancellations must be entered prior to the end of the current service period in order for them to take effect before the next service period begins. Cancellations submitted after the next service period begins, will take effect when that next service period is completed.
No refunds will be given for already started service periods. No refunds will be considered for accounts deleted for violation of our Terms of Service or Terms of Use Policy.

Permitted uses. You may:

Backup and store the Image(s) and File(s) as necessary on computer or media for archival purpose provided that all such computers are physically located at your business, or if you are a residence, your place of residence
Use the Image(s) and File(s) in any electronic or print media, provided such use is not intended to allow the re-distribution or re-use of the Image(s) and File(s).
Modify or alter the Images and Files as necessary for your use
Use the Image(s) and Files(s) as design elements in DVD, video, film, or television broadcasts for commercial or non commercial purposes.
Use the Image(s) and File(s) for any other uses approved in writing by DVDStyle.com
Continue to use the Image(s) and File(s) downloaded during your paid subscription period even after you cancel or not renew your next subscription. However if you decline your payment with credit card company for already occurring subscription period, you may not use the Image(s) and File(s) downloaded during that (not-paid) period and you must delete the files

Prohibited uses. You may NOT:

Sublicense, distribute, transfer or assign the Image(s) and File(s) or rights to the Image(s) and File(s)
Use the Image(s), or any part of the Image(s), as part of a trademark, service mark, or logo. DVDStyle or its licensors retain the full rights to the Image(s), and therefore you cannot establish your own rights.
Use the Images(s) in any format (electronic or not) for creating product that compete with DVDStyle.com. (Which is in business of licensing images to its customers.) This include, without limitation, Web site templates, DVD/CD templates, Video templates, Greeting cards products, e-greetings, etc.
Use the Image(s) in any way that could be considered defamatory, pornographic, libelous, immoral, obscene or fraudulent, or illegal, either by making physical changes to it, in the juxtaposition to accompanying text or images, or otherwise

Protection and Security

Subscriber and user agrees not to disclose, publish, release, transfer, or otherwise make available the Image(s), or any portion thereof, in any form, to any person, other than Subscriber's or User's employees, without prior written consent from DVDStyle.com. User agrees that the Image(s) and File(s) is the property of and proprietary to DVDStyle.com, and further agrees to protect the Image(s) and File(s) and all parts thereof from unauthorized disclosure and use by its agents, employees, or customers.

Warranty

DVDStyle.com warrants to the Subscriber and User that, to the best of its knowledge, the digital data comprising the Image(s) and File(s) do not infringe the rights, including patent, copyright and trade secret rights, of any third party, nor was the digital data unlawfully copied or misappropriated from digital data owned by any third party; provided, however, that DVDStyle.com makes no representation or warranty with respect to infringement of any third party's rights in any image, trademarks, works of authorship or object depicted by such Images(s) and File(s).

Limitation of Damages

DVDStyle.com shall have no liability for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or with respect to this agreement or the program, even if DVDStyle.com has been advised of the possibility of such damages. Further, DVDStyle.com's aggregate liability arising under or with respect to this agreement shall in no event exceed the total commissions paid or payable by Subscriber to DVDStyle.com under this agreement.

Indemnification

Subscriber and User shall defend, indemnify, and hold DVDStyle.com harmless from any actions, claims, or proceedings with respect to the Image(s) or other provisions of this Agreement.
